Privacy Statement

SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at 1 (604) 464-3941.

SECTION 3 – DISCLOSURE
We may disclose your personal information if we are required by law to do so.

Payment:

If you choose a direct payment gateway to complete your purchase, then Eagle Ridge GM stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 4 – THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 5 – SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

TO: EAGLE RIDGE CHEVROLET BUICK GMC LTD (“DEALER”)
AND TO: DealerTrack Canada, Inc. (“DealerTrack”)
AND TO: Each finance source (each a “Financier”) to which DEALER sends through DealerTrack’s internet-based loan origination application currently located at www.dealertrack.ca (the “Portal”), on my behalf, an application for a loan, lease or financing of an actual or proposed motor vehicle, recreational vehicle, motorcycle, or watercraft acquisition or other asset acquisition as determined by the parties;
AND TO: Each aftermarket provider (each a “Provider”) to which DEALER sends through the Portal, or independently through DealerTrack’s internet-based network (the “Aftermarket Network”), on my behalf, an application for an aftermarket product offered by the Provider;
AND TO: GM Canada. DEALER will share your personal information with General Motors of Canada (“GM”) and its affiliates, for the purposes described in and subject to GM’s Privacy Policy, a copy of which can be found at www.gm.ca , (or, as the case may be, subject to the relevant affiliate’s privacy policy)

1. In this consent:
(a) the words “I”, “me” and “my” refer to the undersigned Applicant and, if applicable, to each of the undersigned Co-Applicants, jointly and severally, and (b) the words “you” and “your” refers to each of, DealerTrack, DEALER, Financier, Provider and their respective affiliates and successors and assigns, as well as their respective service providers involved in providing services related to a Transaction (the “Service Providers”).

(b) “use” or “using” includes collecting, copying, storing, maintaining, updating, sharing, transferring, disclosing, and providing access to Personal Information (as defined below) in accordance with this Consent.

(c) “Personal Information” means all identifying information about me, and includes, but may not be limited to: my name; address; telephone number; date of birth; social insurance number; driver’s licence number; mother’s maiden name; my employment history; income; information related to vehicle insurance policies, including but not limited to coverage and claim information; and information concerning my credit, including, information obtained through a credit reporting agency or credit investigation or from a credit bureau or financial institution or other person or entity, and all information provided by and relating to me in any credit application.

(d) “Transaction” means any credit application, price quote, purchase, lease, financing application, and/or service of any motor vehicle, recreational vehicle, motorcycle, watercraft, or other asset by or for me, whether in my own name or on behalf of another person or entity, involving the Portal, Aftermarket Network, and/or all ancillary services provided through the Portal or the Aftermarket Network.

2. I certify that all information provided by me in any credit application or other documentation given in connection with a Transaction is true, accurate and complete in all respects.

3. Your information may be made available by DEALER to third-parties or service providers to fulfill the purposes for which it has been collected or as set forth in this Privacy Policy. DEALER will not sell, rent or trade your personal information to any third party. However we may share your personal information when authorized by law or as follows:

  • GM Canada. DEALER will share your personal information with General Motors of Canada (“GM”) and its affiliates, for the purposes described in and subject to GM’s Privacy Policy, a copy of which can be found at www.gm.ca , (or, as the case may be, subject to the relevant affiliate’s privacy policy)

4. I AUTHORIZE AND CONSENT TO THE USE BY YOU OF MY PERSONAL INFORMATION, FOR THE PURPOSE OF INITIATING, PROCESSING OR EXECUTING ANY TRANSACTION REQUESTED BY ME, AND ALL REASONABLE PURPOSES RELATED THERETO, including:
(a) For legal, regulatory, audit, risk assessment, processing and security purposes (including fraud prevention);
(b) For purposes permitted by Canadian law or required by Canadian or applicable foreign law;
(c) To create aggregated and anonymous information that may be used for your business purposes;
(d) To conduct credit and insurance investigations concerning me from time to time in connection with a Transaction;
(e) To exchange my Personal Information with any credit reporting agency, credit bureau, automobile or other asset insurer or aggregator of information for such insurer and/or financier in connection with considering or proceeding with a Transaction;
(f) For the purposes described in DealerTrack’s privacy notice as updated from time to time (the “Privacy Notice”). The up-to-date version of the Privacy Notice is accessible at http://www.dealertrack.ca. I acknowledge that changes to the Privacy Notice may be made from time to time, and that it is my responsibility to review the Privacy Notice periodically in order to remain up-to-date with any such changes.

5. I acknowledge that, by sending an email to privacyinquires@dealertrack.com or by calling 1-866-360-3863, I may: (1) review and update any Personal Information retained by DealerTrack; and (2) opt out of uses of my Personal Information, provided that I recognize that any such opt-out may prevent completion of the Transaction or of otherwise-provided services.

(1) Collection and Release of Information
DEALER uses information gathered about users only for limited purposes permitted by law. In registering and/or submitting your personal information through this credit application, users allow us and our affiliates to make personally identifiable information available to third parties in accordance with the terms of this privacy policy. While on this site we may collect “Personal Information” from you. In regards to this policy this shall include, though not exclusively, individually identifiable information from, or about an individual form, information the user submits on loan applications; information about user transactions with us or others; and information received from any affiliated loan guarantee agency.
Information collected is needed for and directly corresponds to processing loan applications, administering loan accounts, providing services to customers, providing customers and website visitors with information about site services, and to fulfill any legal and regulatory requirements. Information is retained by DEALER and is not otherwise transferred outside the confines of DEALER and its users, unless permission to do so has been requested or as permitted by law.

We may collect or expand to collect, the internet service providers of visitors. This information is used to improve the performance of the site and the credit application, enhance the user experience and ensure the satisfaction of site visitors, as well as to assist with systems administration, and to resolve problems.

The information tracked may or may expand to include, but is not exclusive to, the type of operating system in use, the type of browser used by the visitor, the pages visited and data requested. We use this information internally to analyze site traffic. From time to time we may create or conduct analyses and summary reports about the operation of the website.

(2) IP Addresses
An IP address is a number automatically assigned to your computer whenever you access the Internet. All computer identification on the Internet is conducted with IP addresses, which allow computers and servers to recognize and communicate with each other. Your IP address may be used to help identify you and to gather broad demographic information about you, to conduct site analysis. DEALER may collect or expand to collect IP addresses in order to conduct system administration, diagnose problems and to better serve you in using the services and features within the site, namely the credit application.

DEALER has security measures in place to protect the loss, misuse and alteration of the information under site control. Any employee or contractor requiring access to user information must be approved and must use information of the uses outlined in the above document. Access is reviewed on a regular basis.

DEALER also uses extensive and sophisticated secure technology to protect your data and transmissions between you and banks, lenders and loan brokers participating in DEALER products and services. Transmission between browsers and our web server, as well as participating lenders is implemented using Secure Sockets Layer (SSL) technology. This technology requires an SSL-capable browser such as MS Internet Explorer 3.0 (or later) or Netscape Navigator 2.0 (or later).

Given that no technology is foolproof, we must also advise users that there will always remain a certain amount of risk and that your personal information may be disclosed, without your consent, unintentionally, and without fault on the part of DEALER. We decline any responsibility in the event that such confidential information is disclosed.

(4) User Information for Those Under 18
You must be at least 18 years old to have our permission to use our credit application. To protect the interests of children, it is the policy of is that no information should be submitted to our web sites by children 18 years of age or under, without the consent of a parent or guardian. DEALER can not be held liable for information unknowingly given to us by underage user, but does not actively seek any demographic or preference information from children, nor will it ever knowingly disclose any personally identifying information regarding children to third parties.
